On appointment Governors are required to declare that they are eligible to be a Governor and agree to a check to ensure that they have not been barred from working with children. The disqualifications are automatic, and are listed below.
You are not eligible to be a governor if:
- You are aged under eighteen
- You are currently liable to be detained under the Mental Health Act 1983(a)
- You have failed to attend full governing body meetings for a six month period, and where the governing body has not accepted apologies
- You have been disqualified for non attendance, LEA governors, co-opted governors, foundation governors, representative governors and partnership governors are disqualified from rejoining the governing body for the period of twelve months in the same capacity
- You have been declared bankrupt, or your estate has been sequestrated, and this has not been annulled or rescinded or that arrangements with creditors have not been discharged
- You have been disqualified as a charity trustee
- You have been disqualified as a company director
- You have been included in the list of teachers and workers who are not allowed to, or have restrictions on, work with children or young people
- You are disqualified from being a proprietor of an independent school
- You hold a criminal conviction, which resulted in a custodial sentence of three months or more. (The length of disqualification is dependant on the length of sentence)
- You have been fined for causing a nuisance or disturbance on school premises during the five years prior to, or since, appointment or election as a governor
- You have refused to have a Criminal Records Bureau check
